Is the situation bellow, legal?

Montreal, Canada. My brother was riding his bike while listening to music (i know, illegal) and a police tried to stop him so he went faster and tried to hide in an alley. The cop found him but he didn't try to escape. He was supportive but the cop grabbed him and put him to the wall (aggressively). My brother called me and started speaking spanish (same moment in front of the cop) the cop obligated him to speak french so he could understand the conversation. The officer then started insulting my brother to another cop on his phone. Now I am pretty sure my brother had the right to speak spanish, in fact, he has the right to speak any language even in front of the officer if the cop grants him the right to a call. No? And if my brother didn't resist the arrest, I guess the verbal and physical abuses on him were illegal too. My brother did in fact do something stupid, but I think this officer abused from his power and did a couple of illegal things him self.
